- By providing your work, government, or school email address, you acknowledge and consent to the receipt of communications from the debt collector at this address, and you acknowledge that third parties may have access to these communications. By providing your work or government email address, you understand and waive any claims regarding third-party disclosure of such communications;
- Only you have access to emails sent to and from the email address provided above;
- You agree to take reasonable precautions to ensure the non-disclosure of email communications with Solverity, which may contain private, sensitive, and/or confidential information;
- Notwithstanding the foregoing, to the extent that any third-party disclosure of email and/or voicemail communications with Solverity occurs, you consent to the disclosure of the same to such third parties;
- You are not represented by an attorney;
- You are not an active member of the United States Military or its Allies; and
- Your account(s) have not been discharged in bankruptcy.
- Your account(s) is/are not part of any pending bankruptcy proceeding.
- You are not a petitioner in any pending bankruptcy proceeding.
- You authorize Solverity to provide any account-related documents to the authorized email address.
- If you make or schedule a payment plan or make a payment before 8:00 AM or after 9:00 PM in your local time zone, and you have agreed to receive email communications regarding your account(s), you then agree to receive emails related to your activity within the payment portal at or near the time of your activity.
- Changes to Terms- We may update these terms and conditions from time to time. Any changes will be effective when we send a new email message or update our terms on our website. Your continued use of the email service constitutes acceptance of the revised terms.
- Liability- Solverity is not responsible for any delays or failures in the delivery of email communications due to issues with your email service provider or other technical problems.

By providing your mobile telephone number to Solverity through this website, you consent to receive text messages from Solverity and its service providers regarding your account, including but not limited to payment reminders, account status updates, and other debt collection communications. You are not required to consent to receive text messages as a condition of paying your debt.
Message frequency varies based on account activity and may include multiple messages per month. Message and data rates may apply depending on your mobile carrier and plan. Solverity is not responsible for any fees charged by your wireless carrier.
You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message, and no further text messages will be sent unless you later provide consent again. Payments
If you choose to use the Website to make an Online Payment, you accept and agree to these Online Payment Terms and Conditions. Among other information, your Account(s) will show your original creditor, seller, merchant, account balance, and may show any account offer(s), if any. You may pay for your outstanding obligations through the Website either by initiating a one-time payment or by enrolling in a payment plan in accordance with these Online Payment Terms and Conditions.
If you initiate any payment through the Website, you authorize Solverity to charge the debit card or credit card you provide [or initiate a debit from the bank account you designate on the Website.] Your transaction must be payable in U.S. dollars. You represent that you have the legal right to use any debit card, credit card or other payment account you designate for payment through the Website. If you are using this Website to make a payment, you agree that if we process a payment accompanied by any restrictive language, such restrictive language will have no effect and will not constitute an accord and satisfaction or a compromise of your account balance.
- Payment Methods. You may, depending on the status of your Account, make a payment on the Website using your debit card or credit card [or by authorizing a debit from your checking or savings account via Electronic Funds Transfer (EFT).] Additional payment methods accepted by Solverity include payment by mail or by telephone.
- One-Time Payments. You may initiate a one-time payment through the Website using your debit card or credit card [or by Electronic Funds Transfer (EFT) from your bank account.] We will process the payment on the date indicated. Your payment may be subject to any limits imposed by your financial institution or the issuer of your credit card.
- You may not pay more than the full balance of your Account or make changes to a payment on the same day that the payment is scheduled to be debited. Changes will go into effect the following business day. Solverity may also impose limits on or reject any payment or transaction if it suspects fraud, unauthorized use of a payment account, or as required by law.
- Payment Plan. You may also set up a payment plan (a "Payment Plan") where your payment amount is deducted automatically from your bank or credit card account on the day indicated. You may cancel the Payment Plan at any time by changing the settings in your Account, but you may not cancel the Payment Plan on the day that a payment is scheduled to be debited. Changes will go into effect the following business day. If you enroll in a Payment Plan, you agree that your [monthly account statement from Solverity will serve as notice of the amount of each payment deduction.]
- Solverity may determine at any time that you are ineligible to participate in Online Payment and remove you from Online Payment, even if you have already enrolled. If this occurs, you will thereafter be required to make payment using an alternative method.
- You are responsible for keeping your payment information up to date and ensuring that your bank account has sufficient funds, or your credit card has enough available credit, to cover the full amount of any payments made to us. If your bank notifies us that there are insufficient funds ("NSF") in your account to pay the amount you authorized for payment or [otherwise rejects an EFT debit request], NSF fees may be imposed on you by your financial institution. Solverity is not liable for any such NSF fees.
- By participating in Online Payment, you agree that Solverity will obtain financial information regarding your designated payment account(s) from your financial institution for the purposes of performing electronic payments, resolving payment issues, and verification.
- If there is an unauthorized electronic fund transfer to, Solverity you must immediately report it to Solverity, your bank or credit card issuer. You may notify Solverity by email or telephone, or in writing. You are liable for subsequent transfers to the extent permitted by state law.
- If you believe an error exists in how a payment was applied, you must notify Solverity of the error by email or telephone, or in writing. Your notice must identify you by name and Account number and indicate why you believe an error exists. Please include the type, date, and amount of the error to the extent possible. Solverity will promptly investigate and report the results of our investigation to you. Most complaints are resolved and closed within 30 days of receipt. If we determine that no error occurred or that an error occurred in a manner or amount different from that described by you, our report of the results of the investigation will include a written explanation of our findings. Upon request, we shall promptly provide copies of the documents.
LIMITATION OF LIABILITY
YOU ACKNOWLEDGE AND AGREE THAT SOLVERITY SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY CLAIM, DAMAGE, OR LOSS RESULTING FROM A CAUSE BEYOND SOLVERITY’S CONTROL, INCLUDING, BUT NOT LIMITED TO, FAILURE OF ELECTRONIC OR MECHANICAL EQUIPMENT OR COMMUNICATION LINES, TELEPHONE OR OTHER CONNECTION PROBLEMS, COMPUTER VIRUSES, UNAUTHORIZED ACCESS, THEFT, OPERATOR ERRORS, SEVERE WEATHER, EARTHQUAKES, OR OTHER NATURAL DISASTERS, STRIKES OR OTHER LABOR PROBLEMS, WARS, OR GOVERNMENTAL RESTRICTIONS.
MOREOVER, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT IN NO EVENT WILL SOLVERITY, ANY OF ITS AFFILIATES BE LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF THE WEBSITE, EVEN IF SOLVERITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
